Attachment of Earning Order

Attachment of Earning Order (“AEO”)

This is where a creditor applies to court for an order allowing them to receive funds directly from your wages.

If it is awarded, your employer will be required to deduct money from your wages until such time that the creditor is paid in full.

A creditor is entitled to apply for an AEO if a County Court Judgement has been made against you and you have not made payment under that judgement.

In order for a creditor to apply for an AEO, you must be employed (but not by the armed forces or if you are unemployed or self employed).

When a creditor applies the court will send you a form to complete requesting full details of your employer together with your income and expenditure.

You must respond to the form issued against you.  If you ignore the form (and any bailiff visit) the court may issue a warrant for your arrest.

Any application for an AEO will take into account your full financial situation.

You can ask the court to suspend the AEO if you don’t want your employer informed.  If the AEO is suspended you must pay the creditor directly.  If you fail to do so the creditor may request the re-issue of the AEO be sent directly to your employer.
