A judgement will be issued against you after first having received a County Court Summons.
The summons is the claim form and the judgment is the second stage in the court process. If you failed to respond to the County Court Summons, or admitted the amount claimed, or lost a counter claim the court will order a judgement be awarded against you.
County Court judgements are also known as “CCJs”. A record of your CCJ is passed, by the court, to the Registry Trust who maintains a Public Record of all CCJ’s issued. Credit Reference agencies take information from the public records (such as this) and place a note of the CCJ on your file.
If you have been ordered to pay a certain amount each month and you cannot afford it you may apply to the court to re-determine the amount. If your circumstances change you should inform the court accordingly.
If you do nothing or default on a CCJ the creditor is then entitled to instruct a Bailiff to collect the debt from you or petition for your bankruptcy.
If you pay the full amount within 1 month of the judgement you may apply to have the judgement removed.
If you pay the amount due after 1 month you may apply to have the judgement marked as satisfied but not removed. This is called a Certificate of Satisfaction and normally costs £10.
