This is, in effect, a formal demand for payment. It is a legal demand requiring you to pay the amount you owe.
If you do not pay, or you ignore the Statutory Demand the creditor may petition for your Bankruptcy after 21 days.
If you have received a Statutory Demand you may apply to have it set aside if:
- There is a dispute rejecting the amount due to the creditor,
- The statutory demand has been issued in error,
- You pay, or can pay the debt,
- You have a counter claim against the claimant,
- The sum you owe is less than £750.
Any application to set it aside must be made within 18 days of receipt of the statutory demand.
