What/who is a bailiff ?

A Bailiff is someone who works on behalf of the Court.

If someone from a Debt Collection Agency comes to your home they are not a Bailiff.  They are merely a representative working for the Agency.  These Debt Collectors have no power and you are not required to speak to them.

A “real” Bailiff receives his instructions to collect debt through a warrant.  The warrant details the Creditor and the amount you owe to that creditor.  (i.e. the amount the Bailiff is looking to recover).  The Bailiff will also be looking to recover enough to clear his charges and expenses.

In certain circumstances a Bailiff can be used to repossess your home or enforce certain arrest warrants.

Bailiffs are commonly used to seize goods for payment of the following types of debts.

  • Council Tax
  • Child Support
  • County Court or High Court Debts (judgements)

There are a few different types of Bailiffs and the law relating to each type of Bailiff is slightly different.
